Terms of Service

By using and/or visiting the zoofs.com web site, a service of Aliqlimiya for Telecom and IT services ("Zoofs website" "zoofs" "website"), you are agreeing to be bound by the following terms and conditions ("Terms of Use" or "Terms" or "Terms of Service" ). If you do not agree to any of these terms, then please do not use the Zoofs website.

  • Please read these terms and conditions. These terms govern your use of Zoofs. Do not use Zoofs if you do not agree to these terms. In this Agreement, we use the term "Content" to mean video, pictures, text, music, data and other content, and we use the term "you" to mean you and any individual or entity that uses Zoofs.
  • We may modify this Agreement at any time. You agree to review this Agreement periodically so that you will be apprised of any changes and to check for any notices we may provide regarding updates to the Agreement. If you continue to use Zoofs after we post changes to the Agreement, you signify your acceptance of the new terms. If you disagree with any changes to the terms, you must discontinue your use of Zoofs before the changes take effect.
  • Zoofs is a service that finds data in people’s conversations and presents them in new ways. Currently, we track Tweets for Youtube videos and weigh them using our own formula. Results shown on Zoofs will include links to Content hosted and served from third party websites (such as Youtube). Some Content and some of these sites may contain materials that are objectionable, unlawful, or inaccurate. By providing access to the Content or these links do not mean that we endorse the Content, these third party sites or services. You acknowledge and agree that we are not responsible or liable to you for any Content or other materials hosted and served from these third party sites. Zoofs is a consumer service.
  • Zoofs is intended for general audiences. Parents and guardians who permit their children to use Zoofs should supervise such access to the website by minors, and are responsible for ensuring that the Content is suitable for those children. Such Content may not be intended to be accessed by children.
  • You acknowledge and agree that Zoofs is supported by advertising, and you agree that such advertising may be presented as part of the Zoofs service. Any dealings that you have with advertisers found on Zoofs are between you and the advertiser, and you acknowledge and agree that we are not liable for any loss or claim you may have against an advertiser.
  • You will use Zoofs for lawful purposes only. You agree that you will not access or use Zoofs or its Content, or otherwise engage in any conduct that:
    1. 1. violates or infringes the rights of others including, without limitation, patent, trademark, trade secret, copyright, publicity or other proprietary rights;
    2. 2. is unlawful;
    3. 3. uses technology or other means to access Zoofs or Content that is not authorized by Zoofs;
    4. 4. use or launch any automated system, including without limitation, "robots," "spiders," or "offline readers," to access Zoofs or Content;
    5. 5. attempts to introduce viruses or any other computer code, files or programs that interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
    6. 6. attempts to gain unauthorized access to our computer network;
    7. 7. violates this Agreement, guidelines or any policy posted on Zoofs;
    8. 8. attempts to damage, disable, overburden, or impair our servers or networks; or
    9. 9. interferes with any other party's use of Zoofs.
    You agree that we may take any legal and technical remedies to enforce this Agreement, including without limitation, immediate termination of your access to Zoofs if we believe in our discretion you are violating this Agreement.
  • We have no duty to monitor or pre-screen Content on Zoofs. We reserve the right to remove Content for any reason.
  • We grant you a personal, non-exclusive, non-transferable, limited and revocable license to use Zoofs subject to the terms of this Agreement. You may not use Zoofs in a manner that exceeds the rights granted for your use of the service and its Content. Without limitation of the foregoing, you may not engage in unauthorized copying or distribution of the Content or creating an unauthorized derivative work. You may not circumvent any mechanisms for preventing the unauthorized reproduction or distribution of the Content or Zoofs service.
  • WE, OUR LICENSORS AND DISTRIBUTORS HAVE NO LIABILITY WITH RESPECT TO YOUR USE OF ZOOFS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE OR OUR PARENT, AFFILIATES, DIRECTORS, EMPLOYEES, DISTRIBUTORS, LICENSORS, SUPPLIERS, PARTNERS, AGENTS OR RESELLERS BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN ANY WAY RELATING TO THIS AGREEMENT OR THE USE OF OR INABILITY TO USE ZOOFS, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF GOODWILL, WORK STOPPAGE, LOST PROFITS, LOSS OF DATA, CORRUPTION OF DATA, COMPUTER FAILURE OR MALFUNCTION. YOUR SOLE REMEDY WITH RESPECT TO ANY DISPUTE WITH US OR ZOOFS IS TO STOP YOUR USE OF ZOOFS.
  • You agree to defend, indemnify and hold harmless Zoofs, its owners, officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney´s fees) arising from: (i) your use of and access to the Zoofs website; (ii) your violation of any term of these Terms of Use; or (iii) your violation of any third party right, including without limitation any copyright, property, or privacy right. This defense and indemnification obligation will survive these Terms and conditions and your use of the Zoofs website.
  • These Terms of Service, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by Zoofs without restriction.
  • You agree that: (i) the Zoofs website shall be deemed solely based in Amman, the Hashemite Kingdom of Jordan; and (ii) the Zoofs website shall be deemed a passive website that does not give rise to personal jurisdiction over Zoofs, either specific or general, in jurisdictions other than the Hashemite Kingdom of Jordan. Any claim or dispute between you and Zoofs that arises in whole or in part from the Zoofs website shall be decided exclusively by a court of competent jurisdiction located in Amman, the Hashemite Kingdom of Jordan. If any provision of the aforementioned terms is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms and Conditions, which shall remain in full force and effect. No waiver of any term of this these Terms and Conditions shall be deemed a further or continuing waiver of such term or any other term, and Zoofs´s failure to assert any right or provision under these Terms and Conditions shall not constitute a waiver of such right or provision.
